Personal Data Protection of the Online Store www.motozahrada.eu, www.motozahrada.sk, www.zahrada-shop.sk

  1. The company ŠIVINET s.r.o., registered office at L.N. Tolstého 1823, 079 01 Veľké Kapušany, Company ID 36617792, registered in the Commercial Register of the District Court Košice I, Section Sro, Insert No. 18407/V (hereinafter referred to as the “Seller” or “Controller”), processes, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “GDPR”), the following personal data:

  • First name, last name

  • Email address

  • Phone number

  • Address / registered office

  1. The above personal data must be processed for the purposes of fulfilling your order and further performance of the contract if a purchase agreement is concluded between you and the Seller. Such processing of personal data is permitted under Article 6(1)(b) GDPR – processing is necessary for the performance of a contract.

The Seller also processes this data for the purposes of contract record-keeping and for the potential future assertion and defence of the rights and obligations of the contracting parties. Storage and processing of personal data for this purpose is carried out for a period of 10 years from the fulfilment of the last part of performance under the contract, unless another legal regulation requires longer retention of the contractual documentation. Such processing is permitted under Article 6(1)(c) and (f) GDPR – processing is necessary for compliance with a legal obligation and for the purposes of the legitimate interests of the Controller.

  1. Newsletters and other commercial communications may be sent to the Buyer’s email address or phone number. This is permitted by Section 62(3) of Act No. 351/2011 on Electronic Communications, unless the Buyer rejects such communications. Such notifications can be unsubscribed from at any time in any way – for example, by sending an email or by clicking on the link contained in the commercial communication.

  2. The processing of personal data is carried out by ŠIVINET s.r.o., as the Controller of personal data. Personal data for this Controller are also processed by processors:
    a. Service provider UPGATES, operated by EVici webdesign s.r.o., Petra Bezruče 139, 747 91 Štítina, Czech Republic
    b. Service provider Heureka, operated by Heureka Shopping s.r.o., Karolinská 650/1, 186 00 Prague 8-Karlín, Czech Republic
    c. Service provider ALLEGRO, operated by Allegro sp. z o.o., ul. Wierzbięcice 1B, 61-569 Poznań, Poland
    d. Courier companies: GLS, QDL, SDS, GEIS, UPS, Zásilkovňa.sk, Zásilkovna.cz
    e. Provider of accounting software and IT system Money S3: Solitea Slovensko, a.s.
    f. Accounting documentation processor: LPR SERVIS, s.r.o.
    g. Všeobecná úverová banka, a.s. (QUATRO instalment sales)
    h. Providers of standard software (e.g., Microsoft) or technical support
    i. Providers of cloud or hosting services (e.g., Google) and Google Analytics tracking
    Personal data will not be transferred to third countries outside the EU.

  4. The Controller, as the operator of the websites www.motozahrada.eu, www.motozahrada.sk, www.zahrada-shop.sk, uses cookies on these websites for the following purposes:

  • Measuring website traffic and generating visitor and behaviour statistics

  • Basic website functionality

  • Website optimisation

  • Evaluating the effectiveness of traffic sources

  • Optimising marketing activities

  • Website performance evaluation

  • User segmentation

  • Remarketing campaigns on Google AdWords

  • Optimising Facebook campaigns

  • Optimising Heureka campaigns

  • Optimising ALLEGRO campaigns

Collecting cookies for the above purposes may be considered processing of personal data. Such processing is permitted on the basis of the Controller’s legitimate interest under Article 6(1)(f) GDPR.

The website can also be used in a mode that does not allow the collection of data about visitor behaviour – this can be set in your browser or by expressing an objection to such processing under Article 21 GDPR. An objection can be expressed at the bottom of the website.

Cookies necessary for the operation of the website will only be stored for the time necessary for its functioning. In the event of an objection to technical cookies necessary for the functioning of the website, full functionality and compatibility of the website cannot be guaranteed.

Cookies collected for statistical purposes are assessed in aggregate and anonymised form, which allows no identification of an individual.

Cookies are stored for the period specified for each type of file.

They are processed by, among others:

  • Google Analytics (Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) – data on interactions, devices, location, operating system, internet provider, etc.

  • Google AdWords Remarketing Pixel – data on user interactions

  • Facebook Like/Share, Facebook Remarketing Pixel – data on purchases, carts, values, purchase frequency, use of discount codes, delivery and payment selection, location, devices, etc.

  • Heureka – “Certified Shop” badge

  1. Under the GDPR, you have the right to:

  • Withdraw consent to the sending of commercial communications

  • Object to processing based on legitimate interest

  • Request information about what personal data we process

  • Access, update, correct, or restrict the processing of your personal data

  • Request deletion of personal data, unless contrary to applicable law or the legitimate interests of the Controller

  • Data portability if data are processed automatically based on consent or contract

  • Obtain a copy of processed personal data

  • Effective judicial protection if your GDPR rights are violated

  • File a complaint with the Office for Personal Data Protection

  1. All legal relationships arising from the processing of personal data are governed by the laws of the Slovak Republic, regardless of where access is made. In the event of a dispute relating to privacy protection, the competent Slovak courts shall have jurisdiction. The data subject may contact the Office for Personal Data Protection (https://dataprotection.gov.sk/uoou/sk).
